Assisting a Japanese telecom equipment manufacturer in tender bidding

Kosta Legal has successfully advised a large Japanese telecom manufacturer on participating in the tender for supplying telecom equipment to one of the Uzbekistan’s largest telecom companies, a state-owned enterprise.

Under the terms of the tender, the winner would have to supply to the customer several large batches of telecom equipment, assist in their installation and render general consultation services for the development of customer’s mainstream telecommunication networks and infrastructure in Uzbekistan. Our role was to assist the Japanese bidder at the pre-tender, tender and post-tender stages as well as during the implementation of its tender offer. Particularly, we had to bring the client’s supply and servicing mechanisms that would be offered to the customer into compliance with tender requirements and Uzbek law, prepare relevant tender bidding documents, participate in negotiations with the customer and involved state agencies, and provide legal assistance in all matters during the implementation stage. It is noteworthy that the tender offer of our client proposed the customer would pay for our client’s services by attracting a preferential loan of the Japan Bank for International Cooperation that significantly complicated our task of structuring the transactions.

Our client was a Japanese major manufacturer of telecom equipment, being an arm of a world-renowned Japanese conglomerate, supplying its equipment for a variety of industries all over the world.

The tender customer was the Uzbekistan’s largest telecom operator – a state-owned corporation providing a full spectrum of telecom services in all regions of the country.
