Lawyers of the PPP and Project Finance Team of Kosta Legal, working alongside lawyers of the London office of Allen & Overy, have successfully assisted the Asian Development Bank, acting as a transaction advisor to the Ministry of Housing and Communal Services, in preparing and conducting an open tender for a PPP project for water supply and wastewater treatment in the city of Namangan, Uzbekistan. This is the first PPP project in the water supply sector in the country. A winner of the tender, Metito Utilities (UK), a part of Metito Holdings, headquartered in UAE and partially owned by Mitsubishi Corporation (Japan) and the IFC, will finance, design, construct, and operate the water supply system of Namangan for 25 years. The total investment in the project will amount to approximately USD 90 mln. The annual base service payment offered by Metito for servicing the project is UZS 97.5 bln (approx. USD 9.8 mln).
The role of our lawyers, led by partner Nail Hassanov and senior associate Jakhongir Olimjonov, was to provide a comprehensive legal advice on structuring the project, to prepare all documents related to the tender, and to assess bidders’ proposals.
