Newsletter on pharmaceutics for March 2020

This legal alert highlights the most important legal developments of March 2020 that affect the Uzbek pharmaceutical industry as a whole and activities of foreign pharmaceutical producers and their representative offices in Uzbekistan in particular.

As the second half of March was overshadowed by the outbreak of COVID-19 and the taking of quarantine measures, we have prepared reviews of relevant legal developments available at this link.

 1.  THE LAW ON NARCOTIC DRUGS

  • The Law on Narcotic Drugs and Psychotropic Substances was amended. There are now some exceptions to the reservation that the state has monopoly over the activities related to narcotic plants.
  • Newly added Art. 211 stipulates that the cultivation, import and export, processing, storage, sale and release, purchase, and transportation of cannabis plants containing the narcotic element tetrahydrocannabinol in the amount of up to 0.2% for the production purposes not related to the production of narcotic drugs and psychotropic substances is permitted to legal entities that have obtained a special license in accordance with the procedure set by law. A list of varieties of the cannabis plant allowed to be used in the activities above will soon be set.

 2.  COVID-19 RELATED MEASURES IN PHARMACEUTICS

  • To counter the spread of the coronavirus, customs duties will not be charged on essential medicines, medical products, medical equipment, and materials used for their production included in a list set by the Ministry for Healthcare and the Agency for the Development of the Pharmaceutical Industry.
  • The State Tax Committee, the State Customs Committee and the Antimonopoly Committee conduct daily monitoring of prices for medicines, medical devices, medical equipment, and materials and substances used for their production to ensure that there are no excessive pricing and creation of artificial demand.
